Short Summary: Recovery for sum of paid money in advance for freight of goods carried from Baltimore to Liberia. The consignee named in the bill of lading was Asbury Johns, a black man (whose freed status was unknown) who the plaintiff had sent goods to Liberia by before. Holding that any coversations that the defendant had with Johns was inadmissible because there was no sufficient evidence that Johns and the plaintiffs were partners or that Johns was free and furthermore that conversations between black persons and white persons are generally inadmisible. However, the court held that evidence of shipping payments combined with other facts to determine whether there was an additional agreement or if the bill of lading had been modified.
