Short Summary: Defendant, a farmer, employed a servant for nine month doing farmwork. The plainitff's cow broke onto the defendant's farm and the servant drove it out and negligently killed the cow in doing so. Holding that it is clear that a master-servant relationship existed between the parties and that the servant was acting in the course of employment as his duty to provide general farm work included the protection of the crops against third parties or their farm anumals. Holding that the master is liable. Note that this case involves "negro servants" after the abolition of slavery.
