The will bequeathed to the complaintant her choice of a maid servant from all of the estate's slaves and any room of her choice in the house. After living in the house until the death of her mother (testator's widow) the testator's sons sold the property and the appellant argues that this prejudiced her from occupying and enjoying the room as she is entitled to in will. The court acknowledged that the appellant should have been reimbursed by this sale but that she received reciprocal benefits in the form of room and board with the brother that was proof of cancelled current obligations.
