The widow did become remarried and the testator's daughter argued that she was entitled to the said property, money, and slaves. Holding that the daughter had superior title as the widow cannot claim title in accordance with the will and then claim title in opposition to the will. The court concluding that the one who enjoys the benefit must bear the burden.
