Short Summary: Interpreting a 1722 law granting recovery for destroying a boundary of trees. The land was sold to Kennard, a free black person seeking recovery. However, the court held that private boundaries are not given the same protection as public boundaries and furthermore that the tree was on the defendant's land and the petitioner's consent was no necessary. Note that the MD Court of Appeals never mention Kennard's race in the opinion, the lower court ruled that "if the said George Kennard is a negro, the plaintiff is not entitled to recover."
