Short Summary: The plaintiff alleged that the defendant shot him in the shoulder and neck and partially disabled him. The defendant offered into evidence that the plaintiff told him that "that if he ever come again on his premises, he would put him where all his negro money could not bail him." Furthermore the defedant offered evidence that the plaintiff told his slave woman that he would shoot the defendant. Holding that previous evidence of assault is admissible in evidence but not justification for a previous assault.
